Resumo:
Este estudo busca elucidar e pacificar as noções sobre o relacionamento sugar e seus efeitos jurídicos, respondendo sobre a possibilidade da relação sugar se tornar uma união estável, bem como a diferenciação do relacionamento sugar com a prostituição. O objetivo é compreender os efeitos jurídicos da relação sugar, se ela é uma mera declaração atípica de vontade ou se permite a exigibilidade de direitos. O estudo foi desenvolvido com base na pesquisa de natureza bibliográfica, utilizando-se do método dedutivo. Para tanto, a pesquisa contou com a psicologia, antropologia e o direito para explicar essa nova relação social. Assim, os efeitos jurídicos que o relacionamento sugar tem, são decorrentes de situações fáticas deficientes do amparo legal, porém a atipicidade do contrato sugar não afasta os direitos, podendo ser convertida em união estável quando preenchida os requisitos, e afastando-se da prostituição pois não é uma venda de prazer, nem mesmo uma profissão.
Abstract:
This study seeks to elucidate and pacify the notions about the sugar relationship and its legal effects, answering about the possibility of the sugar relationship becoming a stable union, as well as the differentiation of the sugar relationship with prostitution. The objective is to understand the legal effects of the sugar relationship, if it is a mere atypical declaration of will or if it allows the enforceability of rights. The study was developed based on bibliographical research, using the deductive method. Therefore, the research relied on psychology, anthropology and law to explain this new social relationship. Thus, the legal effects that the sugar relationship has, are due to deficient factual situations of legal support, however the atypicality of the sugar contract does not remove the rights, and can be converted into a stable union when the requirements are fulfilled, and moving away from prostitution because it is not a sale of pleasure, nor even a profession.
