Resumo:
Este artigo analisa o papel da vítima diante dos crimes sexuais, de modo a averiguar de forma ampla quais os principais entendimentos jurisprudenciais e doutrinários a respeito da vítima diante dos crimes de natureza sexual. Objetiva-se, portanto, por meio deste trabalho, identificar os argumentos mais relevantes daqueles que entendem ser a vítima de alguma forma culpada pelo dano que lhe foi causado, a depender do seu comportamento diante do fato criminoso, assim como apontar a fundamentação daqueles que alegam que o sujeito passivo deste tipo de ocorrência de nada poderia ser culpabilizado, ainda que tenha adotado condutas provocantes com relação ao seu agressor. Para tanto, fora adotado como metodologia a abordagem qualitativa com uso da pesquisa bibliográfica e documental, de natureza aplicada e caráter exploratório. Restar-se-á demonstrado, ao final, que, ainda que a vítima tenha contribuído para a ocorrência de qualquer crime sexual, nada justifica que esta seja violentada sexualmente.
Abstract:
This article analyzes the role of the victim in the face of sexual crimes, in order to investigate comprehensively the main jurisprudential and doctrinal understandings regarding the victim in relation to crimes of a sexual nature. Therefore, the objective of this work is to identify the most relevant arguments of those who understand that the victim depending on his behavior towards the criminal act, is somehow guilty of the harm caused to herself, as well as to point out the reasoning of those who claim that the passive subject of this type of occurrence of nothing could be blamed, even if he has adopted provocative conduct towards his aggressor. For that, a qualitative approach was adopted as methodology, using bibliographical and documentary research, of an applied nature and exploratory nature. It will be demonstrated at the end that even if the victim has contributed to facilitate the occurrence of any sexual offense, there is no reason why it should be sexually assaulted.
