Resumo:
Esta pesquisa tem por objetivo investigar os aspectos culturais concernentes à tese argumentativa da legítima defesa da honra. Para o desenvolvimento do estudo, adotase predominantemente o modo de raciocínio dedutivo e procedimento técnico bibliográfico. Sendo assim, propomos uma análise acerca da relação entre cultura patriarcal e a violência contra as mulheres. Buscou-se abordar sobre a construção histórica e social da legítima defesa da honra. Adentramos na descrição minuciosa sobre o caso “Doca Street”; identificou-se os aspectos basilares da tese da legítima defesa da honra, e por fim, fora realizada a análise do entendimento fixado pelo Supremo Tribunal Federal na Arguição de Descumprimento de Preceito Fundamental nº 779. Assim, observamos que, a aplicação da tese da legítima defesa da honra tem como base os aspectos culturais que permeiam a sociedade, sobretudo o machismo estrutural.
Abstract:
This research aims to investigate the cultural aspects concerning the argumentative thesis of legitimate defense of honor.For the development of the study, the mode of deductive reasoning and bibliographic technical procedure is predominantly adopted. Therefore, we propose an analysis of the relationship between patriarchal culture and violence against women. We sought to address the historical and social construction of the legitimate defense of honor. We go into the detailed description of the “Doca Street” case; the basic aspects of the thesis of the legitimate defense of honor were identified, and finally, the analysis of the understanding established by the Federal Supreme Court in the Arguição de Descumprimento de Preceito Fundamental nº 779 was carried out. Thus, we observe that, the application of the thesis of legitimate defense of honor is based on the cultural aspects that permeate society, especially structural machismo.
