Resumo:
O presente trabalho tem como finalidade, apresentar o teletrabalho como uma alternativa impar no combate a pandemia, de forma dinâmica e inovadora o teletrabalho vem se destacando cada dia mais. O presente trabalho aponta também as principais mudanças legislativas sobre o tema, considerando as alterações impostas pelo decreto que instaurou o estado de calamidade pública no País, e os demais decretos impostos em virtude exclusivamente do vírus covid-19. O trabalho traz ainda decisões judiciais acerca do tema em epígrafe, onde o legislador tende a conceder a prática do trabalho em Home Oficce, reconhecendo assim o importante papel que essa nova atividade laboral vem representando, para a prevenção do vírus e principalmente para manutenção dos empregos durante a pandemia. O trabalho foi desenvolvido com base em pesquisa de bibliografia especializada sobre o tema. Por fim pode-se concluir que o teletrabalho é indiscutivelmente uma ferramenta de suma importância no enfretamento a covid-19, e vai ganhar ainda mais espaço quando a pandemia tiver fim.
Abstract:
The present work aims to present telework as a unique alternative to fight the pandemic, in a dynamic and innovative way telework has been standing out more and more. The present work also points out the main legislative changes on the subject, considering the changes imposed by the decree that established the state of public calamity in the country, and the other decrees imposed exclusively by virtue of the covid-19 virus. The work also brings court decisions on the above theme, where the legislator tends to grant the practice of work in HomeOficce, thus recognizing the important role that this new labor activity has been playing, for the prevention of the virus and mainly for the maintenance of jobs during the pandemic. The work was developed based on a specialized bibliography research on the subject. Finally, it can be concluded that telecommuting is indisputably an extremely important tool in dealing with covid-19, and will gain even more space when the pandemic ends.
