Resumo:
A unidade social conhecida como família possui sua origem constituída em épocas difusas, pois para se reconstituir o passado histórico desta instituição se faz necessário realizar exercícios de abstração que remete às comunidades tribais, ao modo de vida e modo de produção pré-históricos.Com o surgimento de sociedades menos simples e mais complexas e com o crescimento populacional os laços sanguíneos eram facilmente dissolvidos, em Roma, por exemplo, foi criado a expressão família natural, formada apenas pelo casal e pelos filhos, fundamentada no casamento, uma relação jurídica. Que a ideia de família natural se perdurou no mundo ocidental, especialmente com o advento da igreja católica a partir da Idade Média, onde mantinha e incrementava com requintes de autoritarismo o modelo de sistema patriarcal nas unidades familiares. Corroborando a ideia de que família é composta pela figura do pai, da mãe e da prole. Em contrapartida o divórcio acompanha também a consolidação das leis que garantem o direito da família, em 1998 a Constituição vigente no Brasil é promulgada, nela algumas condições legais foram propostas. Alguns anos após entra em cena a Lei 11.441 de 2007, dedicada exclusivamente para o divórcio. Estava sendo inaugurado a Nova Lei do Divórcio, atendendo anseios de defensores de direitos humanos que almejavam uma legislação específica para a promoção e defesa dos direitos da família.
Abstract:
The social unit known as the family has its origin in diffuse constituted times since to reconstruct the past history of this institution is required to perform exercises of abstraction that refers to tribal communities, the way of life and prehistoric mode of production. With the emergence of less simple and more complex societies with population growth and blood ties were easily dissolved in Rome, for example, the expression was created natural family, formed only by the couple and their children, founded on marriage, a legal relationship . That the idea of natural family endured in the Western world, especially with the advent of the Catholic church from the Middle Ages, and which had incrementava with refinements of the model of authoritarian patriarchy in family units. Corroborating the idea that family is composed by the figure of the father, the mother and offspring. Conversely divorce also accompanies the consolidation of laws guaranteeing the right of the family, in 1998 the Constitution in force in Brazil is enacted, it were proposed some legal conditions. Some years after the Act comes into play 11 441 2007, devoted exclusively to divorce. Was being inaugurated the New Law of Divorce, serving desires of human rights defenders who longed for a specific promotion and protection of family rights legislation.
