Resumo:
Apresento neste artigo aspectos que abordam a mediação como meio de resolução ou solução de conflitos entre litigantes. Nesta tangente o objetivo deste estudo é identificar em que alcance a mediação, enquanto ferramenta de acesso à justiça conciliatória é capaz de solucionar por melhor repartição de justiça apresentadas pelas partes. Foram abordados também quesitos como as definições da mediação, subsidiada por alguns autores como Cappelletti e Garth para que fosse possível conhecer os princípios que norteiam a mediação, assim como o papel do mediador, e a finalidade do processo mediatório. A partir dos estudos dos temas e subtemas fez necessário explorar a artigos acadêmicos, jurisprudências, doutrinas, livros e sites caracterizando assim uma pesquisa bibliográfica, tendo como método, o indutivo e analítico-descritivo para que o tema fosse melhor apresentado e objetivo.
Abstract:
I present in this article relevant aspects that deal with mediation as a means of solving or solving disputes between litigants. To the different forms of conflict, mediation appears as an important role in the resolution or mitigation of actions that can be resolved without the procedures required in the judiciary. The objective of this study is to identify the extent to which mediation can be achieved, as a tool for access to conciliatory justice, which can be solved by a better distribution of justice presented by the parties. It was also addressed issues such as the definitions of mediation, subsidized by some authors such as Cappelletti and Garth to make it possible to know the principles that guide mediation, as well as the principles that guide mediation, as well as the role of the mediator and the purpose of the mediation process. From the studies of the themes and sub-themes, it was necessary to explore the academic articles, jurisprudence, doctrines, books and websites characterizing a bibliographical research, having as method, the inductive and analytical-descriptive so that the theme was better presented and objective.
