Resumo:
O artigo em epígrafe teve como objetivo verificar o atual posicionamento dos Tribunais Superiores, quais sejam, Supremo Tribunal Federal (STF) e Superior Tribunal de Justiça (STJ), acerca de aspectos relativos aos crimes contra o patrimônio, mais especificamente quanto aos delitos de furto e roubo, esmiuçando a temática sob a ótica jurisprudencial e apontando, ao final, se o juízo hodierno dos referidos Tribunais é, quando confrontado ao entendimento doutrinário, mais benéfico ou maléfico ao acusado. Examinou-se, ainda, as possíveis causas que levam os indivíduos a praticarem crimes patrimoniais e os resultados evidenciaram que fatores socioeconômicos influem diretamente na criminalidade e que o recente posicionamento dos Tribunais, quanto as questões abordadas, é, no geral, ríspido no combate a delinquência.
Abstract:
The aforementioned article had as an objective to verify the current stance of the Superior Courts, namely, the Brazilian Federal Supreme Court (In Brazil: STF) and the Brazilian Superior Court of Justice (In Brazil: STJ), regarding aspects related to crimes against property, more specifically towards the crimes of theft and robbery, analyzing the subject under the optics of jurisprudence and pointing out, at the end, whether the hodiernal Court's judgment is, when confronted with the doctrinal understanding, more beneficial or malefic to the accused. Still, the possible causes that lead individuals to commit property crimes were examined, and the results showed that socioeconomic factors directly influence in the criminality and that the recent position of the Courts, as for the issues addressed, is, in general, harsh in the fight against delinquency.
