Resumo:
Esse artigo procurou debater uma nova abordagem em relação à condição do homem perante a Lei 11.340, conhecida como Lei Maria da Penha. Nela, é discutida a possibilidade do sexo masculino ser também favorecido pelas medidas protetivas dessa Lei atuando assim, também como sujeito passivo. Justificou-se tal possibilidade com embasamento na Constituição Federal em oposição ao argumento da diferença entre gêneros que foi estabelecida durante toda a História da sociedade. Questionou-se ainda a sua constitucionalidade confrontando teses com opiniões diversas. Percebeu-se que o sistema protetivo instaurado pela Lei pode ser aplicada a todos os vulneráveis sem ferir os princípios pelos quais foi criada.
Abstract:
This article aims to discuss a new approach to the human condition before the Law 11.340, known as the Maria da Penha Law. In it, the possibility male also be favored by the protective measures that Act thus acting also as subject is discussed. Was justified on the basis that possibility with the Federal Constitution in opposition to the gender gap that has been established throughout the history of society argument. Also questioned its constitutionality confronting theses with different opinions. Thus, it was noticed that the protective system established by Law can be applied to all vulnerable without hurting the principles by which it was created.
