Resumo:
O presente trabalho tem como escopo identificar a lacuna deixada pelo legislador no que tange à questão da flexibilização do horário de trabalho do trabalhador-estudante. O objetivo é compreender que tanto o direito ao trabalho quanto o direito à educação são inerentes à todas as pessoas, e, sendo assim, não há que se falar em escolha de um direito, devendo o Estado municiar de alguma forma o direito tanto à educação quanto ao trabalho. Nesse contexto, o trabalho se propõe a explanar acerca dos direitos fundamentais e demonstrar que não há respaldo na seara jurídica para que haja a facilitação do ingresso do trabalhador à uma instituição de ensino, o que fere os direitos fundamentais no que tange a educação e ao trabalho.
Abstract:
The present paperwork aims to identify the blank left by the legislator relative to the question of the flexibilization of the work schedule of the student-worker. The goal is to understand that both the right to work and the right to education are inherent to all the people, and, therefore, there is no need to talk in choice of a right, forcing the State to provide in anyways both the right to education and the right to work. In this context, the proposal of the paperwork is to explain about the fundamental rights and demonstrate that is not any backing in the juridical area so that there is a facilitation to the entrance of the working people in an educational institution, what hurts fundamental rights with regards to education and to the work.
